PUBLIC AGREEMENT-OFFER

(hereinafter referred to as the Online Store) 

This public offer (hereinafter - the Offer) is an Agreement concluded between the online store and the user of services - an individual (hereinafter - the Buyer), which determines the conditions for the purchase of goods, works and / or services using the resources of the online store. 

1. GENERAL
   • The online store publishes this Offer with an offer to individuals and legal entities in accordance with Articles 395, 396 and 447 of the Civil Code of the Republic of Kazakhstan (hereinafter referred to as the Civil Code of the Republic of Kazakhstan).
   • This Offer, like any Agreement, defines the essential conditions for interaction between the Online Store and the Buyer (the person who accepted the Offer).
   • This Offer is concluded between the Buyer and the online store at the time of placing the order.
   • The offer can be accepted by any individual or legal entity on the territory of the Republic of Kazakhstan who intends to purchase goods, works or services sold / provided by the online store located on the website 88888.kz.
   • The buyer unconditionally accepts all the conditions contained in the offer as a whole (i.e. in full and without exceptions).
   • In case of acceptance of the terms of this Offer, an individual or legal entity becomes the Buyer.
   • Acceptance is the receipt by the online store of a message about the intention of an individual or legal entity to purchase goods, works and / or services on the terms offered by this online store.
   • The offer, all changes, annexes to it, as well as all additional information about the goods, works and / or services of the online store are published on the website 88888.kz. 

2. STORE WEBSITE STATUS
   • The online store 88888.kz is the property of IP “88888KZ”. The online store 88888.kz is designed to organize a remote method of selling goods, works and/or services via the Internet.
   • By accepting the Offer (i.e. paying for the order placed on the website of the online store), the Buyer receives ownership of the goods, works and / or services posted on the website 88888.kz.
   • The online store 88888.kz is not responsible for the content and accuracy of the information provided by the Buyer when placing an order on the website of the online store. 

3. BUYER STATUS
   • The buyer is responsible for the accuracy of the information provided when placing an order, and its purity from claims of third parties.
   • The Buyer confirms his agreement with the conditions established by this Offer by putting a mark in the column "I have read the terms of the Agreement in full, I understand all the terms of the Agreement, I agree with all the terms of the Agreement" when placing an order.
   • The information provided by the Buyer is confidential. The buyer, by providing his personal data, registering on the site or filling out an application, gives his consent to the processing of his personal data in order to fulfill the user agreement. The online store uses information about the Buyer solely for the purpose of operating the online store (sending a notice to the Buyer about the completion of the order, etc.) and in the cases specified in this Offer.
   • The Goods are purchased by the Buyer solely for personal, family, household needs not related to business activities. 

4. SUBJECT OF OFFER
   • The online store, on the basis of the Buyer's orders, sells goods, works and / or services to the Buyer in accordance with the conditions and at the prices established by the online store on the website of the online store.
   • Delivery of goods, works and / or services ordered and paid for by the Buyer is carried out by the Online Store or third parties involved by the Online Store to fulfill their obligations. The buyer has the right to pick up the goods, works and / or services at the location of the online store independently by self-delivery. When placing an order, the buyer is given the right to choose the method of delivery.
   • The relations between the Buyer and the Online Store are subject to the provisions of the Civil Code of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan "On Protection of Consumer Rights", as well as other regulatory legal acts of the Republic of Kazakhstan governing the rights and obligations of the Parties specified in this Offer.
   • An individual or legal entity is considered to have accepted all the terms of the Offer (acceptance) and its annexes in full and without exception from the moment the Online Store receives a message about the Buyer's intention to purchase goods, works and / or services on the terms proposed by the Online Store. In case of acceptance of the Offer, an individual or legal entity is considered to have entered into an Agreement for the sale of ordered goods, works and / or services with the Internet store and acquires the status of a Buyer. 

5. PROCEDURE FOR CONCLUDING THE AGREEMENT OF PURCHASE AND SALE
   • The buyer can place an order independently on the website of the online store, or through a specialist of the online store at the phone number indicated on the site, under the terms of the Sales Agreement.
   • When placing an order on the website of the online store, the Buyer is obliged to provide the following data:

• Full name, IIN (for individuals) or full name, BIN (for legal entities);
• The name of the institution;
• Data of the recipient of the goods;
• Contact phone number and e-mail address of the Buyer of the Goods.
  • The will of the Buyer is carried out by entering the relevant data into the order form on the website of the online store, or by submitting an application through a specialist of the online store using information and telecommunication means or by e-mail (e-mail).
  • The online store does not edit information about the Buyer. 

  • The Seller and the Buyer guarantee that they have the necessary legal capacity and legal capacity, as well as all the rights and powers necessary to enter into the execution of the Retail Purchase and Sale Agreement for the Goods.

  • In accordance with the Code of the Republic of Kazakhstan dated September 18, 2019 No. 193-IV “On the health of the people and the healthcare system,” the sale of tobacco products to persons under the age of 21 is prohibited.

  • By ordering goods through the Electronic Storefront, the Buyer unconditionally accepts the terms of this offer. The Order of the Product placed by the Buyer on the website is a confirmation of the conclusion of this Agreement between the Seller and the Buyer.

6. PRODUCT INFORMATION
   • Goods, works and / or services are provided for display on the website of the online store through graphic images-samples, are the property of the online store.
   • Each graphic image, sample is accompanied by textual information: name, size range (if necessary), price and description.
   • All information materials presented on the website of the online store are for reference only and cannot fully convey information about the properties and characteristics of goods, works and / or services, including colors, sizes, shapes, etc. If the Buyer has any questions regarding the properties and characteristics of goods, works and / or services, the Buyer must contact the online store specialist at the numbers indicated on the site before placing an order.
   • At the request of the Buyer, the specialist of the online store is obliged to provide (by phone or via e-mail, or WhatsApp messenger) other information necessary and sufficient, from the point of view of the Buyer, to make a decision on the purchase of goods, works and / or services.
   • The Buyer is notified that by purchasing goods, works and / or services at a discount established in connection with shortcomings (defects) of goods, works and / or services, the Buyer loses the right to refer to such shortcomings (defects) in the future.
   • The buyer is notified by the online store that the goods, works and / or services indicated in the invoice for payment in separate items in any case are not a set. 

7. PROCEDURE FOR PURCHASING GOODS
   • The buyer has the right to place an order for any product, work and / or service provided on the website of the online store. Each product, work and/or service can be ordered in any quantity not exceeding 20 kg. per final recipient. Exceptions to this rule are indicated in the description of each product, work and / or service in the event of promotions, withdrawal of goods, work and / or services from sale, etc.
   • The order can be placed by the Buyer by the phone numbers indicated on the site, or placed independently on the site.
   • After placing an order, the online store confirms the order of the Buyer by sending information confirming the acceptance of the order to the e-mail or WhatsApp messenger of the Buyer, indicating the name, size, price of the selected product, characteristics of work and / or services and the total amount of the order or a specialist of the online store contacts the Buyer by phone to clarify the necessary characteristics of goods, works and / or services.
   • In the absence of goods in stock, the specialist of the online store is obliged to notify the Buyer about this (by phone or via e-mail, or WhatsApp messenger).
   • The buyer has the right to make a preliminary order for goods temporarily out of stock.
   • In the absence of goods in stock, the Buyer has the right to replace it with another product or change the order by notifying the Seller.
   • The delivery time of the goods is no more than 30 (thirty) calendar days and begins to be calculated on the next day after the Online Store receives a message about the Buyer's intention to purchase the goods on the terms proposed by the Online Store. 

8. PRICE OF GOODS, WORKS AND/OR SERVICES
   • The price indicated on the website of the online store is indicated in tenge of the Republic of Kazakhstan per unit.
   • The price indicated on the site can be changed by the online store unilaterally, while the price of the goods ordered and paid by the Buyer, works and / or services is not subject to change.
   • The total cost of the order consists of the catalog price and shipping costs.
   • The cost of goods, works and / or services provided to the Buyer when purchasing goods, works and / or services on the website of the online store is indicated in the "Delivery" section. 

9. PAYMENT FOR GOODS
   • Methods and procedure for payment for goods are indicated on the website in the "Payment" section. If necessary, the procedure and terms of payment for the order are negotiated by the Buyer with a specialist of the online store.
   • Payment by bank transfer is made according to the order placed by full prepayment. After the receipt of funds to the account of the online store, the specialist processes the order. With a non-cash form of payment, the Buyer's obligation to pay the price of the order is considered fulfilled from the moment the relevant funds are credited to the current account specified by the online store.
   • The buyer pays for the order in any way available on the website of the online store.
   • The settlements of the Parties when paying for the order are carried out in tenge of the Republic of Kazakhstan. 

10. GOODS DELIVERY
    • Methods, order and terms of delivery of goods are indicated on the website in the "Delivery" section. The procedure and conditions for the delivery of the ordered goods to the Recipient are negotiated by the Buyer with the specialist of the online store and are indicated in the form when placing the order.
    • Pickup of goods:
      • The online store, having received a notification of the placed order, confirms its receipt by phone, e-mail, or WhatsApp messenger of the Buyer and agrees with him the date of self-delivery of the goods.
      • In case of a non-cash form of payment, the Online Store additionally by phone or by e-mail of the Buyer confirms the fact that the payment for the order has been credited to the settlement account of the Online Store and only after that agrees with the Buyer on the date of delivery of the goods.
      • Ownership and the risk of accidental loss, loss or damage to the goods passes to the Buyer from the moment the goods are transferred to the Buyer, or his Representative.
    • Delivery of goods by the online store:
      • The transfer of ownership and the risk of accidental loss, loss or damage to the goods passes to the Buyer from the moment the goods are transferred to the Recipient at the place of execution of the contract from the moment the Parties sign the consignment note.
    • Delivery of goods by Carrier:
      • The right of ownership and the risk of accidental death, loss or damage to the goods passes from the online store to the Buyer or the Carrier (in accordance with the agreement concluded between the Buyer and the Carrier) from the moment the goods are transferred to the Carrier at the place of execution of the contract when the Parties sign the act of acceptance and transfer of goods (commodity bill of lading and/or waybill and/or bill of lading).
      • The obligation to transfer the goods to the Buyer, including clause 10.4.1., is considered fulfilled from the moment the goods are transferred to the Carrier.
      • The cost of delivery of goods within each order is calculated based on the weight and volume of all ordered goods, the address of delivery of the order, the rates of the carrier and is paid by the Buyer independently.
    • The recipient is obliged to accept the goods in quantity and assortment at the time of its acceptance.
    • Upon receipt of the goods, the Buyer must, in the presence of a representative of the Internet store (carrier), check its compliance with the consignment note, make sure by the name of the goods in the quantity, quality, completeness of the goods.
    • When accepting the goods, the Buyer or the Representative confirms with his signature on the consignment note that he has no claims to the appearance and completeness of the goods. 

12. GOODS WARRANTY
    • The warranty period for the sold goods, works and services is not provided. 
13. PURCHASE RETURNS

    Returning goods before payment

    We deliver to your specified time slot and address so you can review and make your final purchasing decision. If you decide to cancel your order before actual delivery, you can cancel the order by contacting us at the contacts listed at the end of the article.

    Return of goods after payment

    Return of food products:

    You can return the product to us only if it arrived to you in poor quality.

    According to paragraphs 1-1 and 2 of Article 30 of the Law of the Republic of Kazakhstan “On Protection of Consumer Rights”, food products are subject to return or exchange in the event of the sale of expired goods or the consumer discovering deficiencies.

    A defect is a violation of mandatory requirements for a product. For example:

    • unfit for food products and other characteristics that make products unfit for consumption;

    • manufacturing defects;

    • expired product;

    • goods delivered with damaged packaging.

    When paying by card through a POS terminal or paying online, you can return the goods, but recalculation will be made within 3-5 business days.

    If everything is in order with the packaging, expiration date and presentation, then food products of proper quality cannot be returned or exchanged. Such characteristics as the taste of the product (for example, unsweetened grapes, sour oranges or insufficiently juicy tomatoes), depending on the personal opinion and taste of the buyer, are also not subject to the return and exchange rules. 

    Return of non-food products:

    The buyer may return a non-food product of proper quality within 14 days, not counting the day of purchase, if the specified product does not fit:

    • form

    • dimensions

    • style

    • colors

    • size

    • picking

    Return of non-food products of proper quality is made only if the specified product:

    • was not in use

    • retained its presentation

    • retained consumer properties

    • retained factory tags

    • has a sales receipt (invoice)

    According to the Law of the Republic of Kazakhstan dated December 29.12.14, 269 No. XNUMX-V “On the Protection of Consumer Rights,” the following categories of goods are not subject to return/exchange:

    1) medicines and medical devices;

    2) underwear;

    3) hosiery;

    4) animals and plants;

    5) goods by the meter, namely fabrics made from fibers of all types, knitted and curtain fabrics, artificial fur, carpets, non-woven materials, ribbons, lace, braid, wires, cords, cables, linoleum, baguette, film, oilcloth;

    6) subscriber device of cellular communication.

14. LIABILITY OF THE PARTIES
    • The parties are responsible in accordance with the legislation of the Republic of Kazakhstan.
    • The online store is not responsible for damage caused to the Buyer as a result of improper use by the Recipient of goods, works and / or services ordered on the website of the online store.
    • The Parties are released from liability for non-fulfillment or improper fulfillment of obligations under the Offer for the duration of force majeure circumstances. 

14. OTHER CONDITIONS
    • The relations between the Buyer and the Online Store are subject to the rules determined by the legislation of the Republic of Kazakhstan.
    • If necessary, the Online Store and the Buyer have the right to draw up a contract for the sale of goods at any time in the form of a written bilateral agreement that does not contradict the provisions of this Offer.

    • This Offer comes into force from the date of its acceptance by the Buyer and is valid until the full fulfillment of obligations by the Parties under it.
    • All disputes and disagreements arising from the fulfillment by the Parties of their obligations under this Offer are resolved through negotiations, and if it is impossible to resolve them through negotiations, the Parties have the right to apply for resolution of such disputes to the judicial authorities of the Republic of Kazakhstan at the location of the online store.
    • The online store reserves the right to expand and reduce the product offer on the site, regulate access to the purchase of any goods, works and / or services, as well as suspend or stop the sale of any goods, works and / or services at its own discretion.
